1. Acceptance of Terms
By accessing or using the SailingMetrics platform, you agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms applicable to specific services. If you do not agree, you must not use the platform.
2. Eligibility
Users must be at least 16 years old or have the consent of a legal guardian to use the platform. Users are responsible for ensuring their compliance with local laws regarding the use of online platforms.
3. User Accounts
Registration: Users must provide accurate information during registration and keep it updated.
Account Security: You are responsible for safeguarding your account credentials and agree not to share them with others.
Account Deletion: You may delete your account at any time via your account settings or by sending a written request to info@sailingmetrics.com. Upon deletion, your personal data will be erased in accordance with our Privacy Policy and applicable legal retention periods.
Termination: SailingMetrics reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent or harmful activities.
4. User-Generated Content
Ownership: Users retain ownership of content they upload, including sailing session data, videos, and comments.
License for platform operations: By uploading content, you grant SailingMetrics a non-exclusive, worldwide, royalty-free license to use, display, and distribute the content solely for the purpose of operating and providing the platform's features (e.g. displaying your tracks, enabling sharing with other users).
Promotional use: We will only use your content (e.g. screenshots, track replays) for marketing or promotional purposes if you have given separate explicit consent. You may withdraw such consent at any time by contacting us at info@sailingmetrics.com.
Prohibited Content: Users must not upload content that infringes on third-party rights or violates any applicable laws.
5. Data Collection and Privacy
Data Use: SailingMetrics collects and processes data according to our Privacy Policy. This includes GPS tracking data and video recordings.
User Consent: GPS tracking and video/audio recording features require your active consent, which is requested in the app or platform at the point of use. You may withdraw consent at any time. Live GPS sharing is activated only by your explicit action; see our Privacy Policy for full details.
Security: We implement reasonable measures to protect user data but cannot guarantee complete security.
6. Platform Usage
Permitted Uses: Users may use the platform for personal and competitive sailing activities, as described in these terms.
Prohibited Uses: Users must not misuse the platform, including hacking, interfering with other users, or using the platform for illegal activities.
7. Liability and Disclaimers
General Disclaimer: The platform is provided on an "as is" and "as available" basis. SailingMetrics makes no guarantees about the accuracy, completeness, or reliability of the platform's analytics or other services. User Responsibility: Users are responsible for their sailing activities and should not rely solely on data provided by SailingMetrics for navigation or safety. Prudent seamanship must be applied when using the software.
Limitation of Liability: To the fullest extent permitted by law, SailingMetrics shall not be liable for any indirect, incidental, or consequential damages arising from the use of the platform.
8. Competition Rules and Fair Play
Participation: Users participating in hosted competitions must comply with competition rules outlined on the platform.
Conduct: Any cheating, manipulation, or breach of fair competition principles will result in disqualification and potential account termination.
Published results: Competition results, rankings, and associated performance data (e.g. finishing times, positions, handicap scores) may be published publicly on the platform as part of the competition record. By entering a competition on the platform, you acknowledge and consent to your results being published in this way.
Organiser responsibility for third-party data: Where an organiser enters results on behalf of participants who are not registered users of the platform, the organiser acts as an independent data controller in respect of those entries. By submitting such results, the organiser warrants that (a) the competition was conducted under publicly available sailing instructions or a notice of race that informed participants their results would be published, and (b) the organiser has the authority to submit and publish those results on the platform. SailingMetrics processes such entries on the basis of the legitimate interest in maintaining accurate sporting records (Art. 6 Nr. 1 f) GDPR). Organisers must not enter personal data of third parties beyond what is necessary to identify a result entry (name, boat name, class, and score).
Series rankings from publicly available results: Any user may submit results drawn from publicly published sources (e.g. official event results, notice boards, or class association records) for the purpose of computing series or fleet rankings. By doing so, the user acts as an independent data controller for those entries and warrants that (a) the source data is already publicly available and the user has the right to reproduce and re-publish it, (b) only data strictly necessary to identify a result entry is submitted (name, boat name, class, and score/finish position), and (c) the user accepts full responsibility for any claims arising from their submission. SailingMetrics processes such entries on the basis of legitimate interest in maintaining accurate sporting records (Art. 6 Nr. 1 f) GDPR) but accepts no liability for submissions made under this provision.
Right to object: Any individual whose name appears in published results may request removal by contacting info@sailingmetrics.com. We will assess each request and act in accordance with our Privacy Policy.
9. Intellectual Property Rights
SailingMetrics IP: All content, software, and features provided by SailingMetrics remain the property of the company or its licensors.
Third-Party IP: Users must not use third-party intellectual property without authorization.
10. Third-Party Links and Content
SailingMetrics may include links to third-party websites or services. We do not endorse or take responsibility for third-party content and recommend reviewing their terms and privacy policies.
11. Modifications to the Terms
SailingMetrics reserves the right to modify these terms. We will notify you of material changes via email to the address registered on your account, or through a prominent notice on the platform, at least 30 days before the changes take effect. If you do not agree with the updated terms, you may close your account before the changes take effect. Continued use of the platform after that date constitutes acceptance of the revised terms.
12. Governing Law and Jurisdiction
These terms shall be governed by and construed in accordance with the laws of Germany. Disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Aalen, Germany.
